NBC News and other outlets have confirmed a New York Times report that the probe initiated by Attorney General William Barr, and being conducted by U.S. Attorney John Durham into the origins of the Russia investigation, has changed from what was an “administrative review” into a criminal investigation.
It’s not clear when the change occurred, but the probe began in May as an administrative review. The investigation’s new status means Durham can now subpoena witnesses, file charges, and impanel fact-finding grand juries.
A source familiar with the matter told Fox News that DOJ Inspector General Michael Horowitz’s upcoming report on alleged FBI surveillance abuses against the Trump campaign will shed light on why Durham’s probe has become a criminal inquiry. Horowitz announced on Thursday his report would be available to the public soon, with “few” redactions.
Durham’s probe had recently expanded significantly based on new evidence uncovered during a trip to Rome with Attorney General Bill Barr. Barr reportedly told embassy officials in Italy that he “needed a conference room to meet high-level Italian security agents where he could be sure no one was listening in.”
President Donald Trump has repeatedly called the Russia investigation conducted by special counsel Robert Mueller a “witch hunt.” Republicans have suggested the Mueller investigation stemmed from a plot by members of the Obama Administration and career intelligence officials, in what they call the “Deep State,” to undermine Trump.
Sources told Fox News that Durham was “very interested” to question former Director of National Intelligence James Clapper and former CIA Director John Brennan, an anti-Trump critic who recently dismissed the idea. The New York Times reported Thursday that Durham’s criminal review has prompted some CIA officials to obtain criminal legal counsel in anticipation of being interviewed.
The upgrade to a criminal investigation comes as President Trump is already facing scrutiny about a potential abuse of power, including a House impeachment inquiry examining whether he withheld military aid in order to pressure the president of Ukraine to launch an investigation of former Vice President Joe Biden and his son Hunter.
They New York Times has suggested that the change from an “administrative review” into the origins of the Mueller probe into a criminal investigation represents President Trump using the Justice Department to go after his perceived enemies.

So what if President Trump did strike any such deal with Ukraine? It is not an impeachable offense, but an honorable one. If Biden and his son were engaged in illegal practices then the American people have a right to know that. Many have wondered why the Dems are continuously allowed to get away with their witch hunt tactics against our duly elected President with out any consequences to their behaviors; Hillary, Comey, Mueller, Pelosi, Warren, Schiff, and the rest of these crooks should have all been impeached and jailed long ago. This is what they fear from Trump as he promised to drain the swamp and hold all of these criminals accountable. They fear that if Trump wins again, he will have the time to actively go after them and uncover their crimes. They have managed thus far to stall the President’s efforts by throwing out these ridiculous accusations against him to keep him tied up with defending himself and handling this Countries issues at the same time. I applaud Barr’s decision to up the anti by making this a criminal investigation, which should have been done at the beginning of the Russian collusion farce. Anyone responsible for making those false allegations, trying to set Trump up, are guilty of conspiracy, fraud, treason, communism, etc… and need to be held accountable for their involvement in that as well as all of the other crimes they have committed not just against our President but against the American people as well. We want the swamp drained, and the Democrats, with their open disdain towards this country impeached and served with the consequences of their actions to the fullest extent. No President, now or in the future should ever have to undergo and suffer what President Trump and his family have had to endure just because he is fulfilling his promises to the American people and draining the swamp of it’s corruption.
